Definitions

User or Client refers to the individual or entity using Globolingua's services, either as a private individual or as a legal entity.

Services include translation, interpreting, subtitling, transcription, proofreading, voice recording, foreign-language typesetting and other language-related services offered through the website.
Translator refers to the independent professional performing the translation services.
You refers to the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
1. Nature of services
Globolingua takes the translation order from the customer who has registered on our site and passes the order to the translator, or translates by technical means, after which an additional quality check of the translation is carried out where necessary, and the completed translation is sent to the client. Because orders differ not only in volume but also in complexity, depending on the language and the subject matter, the time and the price of fulfilment of an order may vary. The exact information is provided with the order.
Our services can help clients with more than text files: they also cover interpreting by telephone or videoconference, voice recording (voice off and voice over), subtitling, proofreading, foreign-language typesetting and transcription of audio files, offered to the client within the framework of an offer or a contract signed between Globolingua and the Client.
Globolingua focuses on professional non-notarised translations, that is informative translations, such as website and social media content, educational materials for students who need translation assistance, and texts for aspiring writers. Clients are permitted to use translations for any purpose except legal or official uses, such as court submissions, unless explicitly agreed otherwise. We allow our translations to be used in the public domain by adding them to websites or social media.
We carefully select the translators we work with. That includes a test assignment before cooperation begins, our own system of checking completed assignments, internal quality assessment, and a variable system of payment to our translators depending on the improvement of their performance.

5. Fraud prevention
If we discover that your account was created using fraudulent information, or that services were paid for using someone else's payment method without authorisation, your account may be terminated immediately.
6. Email verification
A verification link is sent to the email address you provide. Your account is activated only after you confirm this email. Email confirmation is required in order to receive a completed order.
7. Online store terms
By agreeing to these Terms of Use, you represent that you are at least the age of majority in your state or province of residence, and that you have given us your consent to allow any of your minor dependents to use this website.
You may not use our services for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction, including but not limited to copyright laws.

These include submitting falsified contracts, fake identification documents, or academic dishonesty, as well as translations containing hate speech, violence, discrimination, or any content that violates ethical standards.
Globolingua reserves the right to monitor accounts for prohibited activities and to report violations to the relevant authorities.
In addition to other prohibitions set out in these Terms of Use, you are prohibited from using the website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that affects the functionality or operation of the Service, of any related website, of other websites, or of the internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service, of any related website, of other websites, or of the internet. If it is discovered that an underage individual has created an account or used our services, the account may be terminated immediately, and any associated payments may not be refunded. Users are solely responsible for understanding and complying with the tax laws of their country regarding payments made to Globolingua. Users are responsible for ensuring that translations are used in compliance with applicable laws and regulations.
11. Risks of the service
Globolingua connects clients with professional translators but does not perform the translations directly. This introduces some risks, such as variations in style. We cannot guarantee that all customer orders will be made in the same style of translation. Globolingua facilitates the process but is not liable for inaccuracies or stylistic errors in the translations.
12. General conditions
BLUEOCEAN DEVELOPMENT AI LTD reserves the right to refuse service to anyone for any reason at any time.
You understand that your content, not including credit card information, may be transferred unencrypted and may involve (a) transmissions over various networks and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service, or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
13. Accuracy, completeness and timeliness of information

You agree to provide current, complete and accurate purchase and account information for all purchases made through the website. You agree to update your account and other information promptly, including your email address and payment card details, so that we can complete your transactions and contact you as needed.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time, or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all services delivered to you through it are, except as expressly stated by us, provided "as is" and "as available" for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.
In no case shall Globolingua, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort including negligence, strict liability or otherwise, arising from your use of any of the service, or for any other claim related in any way to your use of the service, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content posted, transmitted or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.
20. Severability
If any provision of these Terms of Use is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Use. If, in our sole judgement, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Use, we may also terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services or any part of them.
Globolingua reserves the right to terminate accounts for non-payment or fraudulent payment, and for violation of these Terms or of applicable laws.
If services are paid for using unauthorised payment methods, the account will be terminated and payments may not be refunded.
22. Delivery terms
Your translation project is delivered electronically to your registered email address, or directly through your account on our platform, within the agreed timeframe. Delivery times are determined based on the complexity and volume of the project, as outlined at the time of purchase. We work to deliver on time and will communicate any potential delays promptly.
23. Complaints
We value your feedback and are committed to addressing complaints about the quality of our services promptly and effectively. Below is an outline of how complaints are accepted and handled, and the scope of issues they can address.
How to submit. Complaints must be submitted in writing by email to [email protected] and include your name and account information, the order number and date, a detailed description of the issue, and specific examples of the quality concerns. Complaints are accepted only if sent from the email address verified during registration.
Time limits. Complaints must be submitted within 7 calendar days of receiving the completed translation or service. Once your complaint is received, we acknowledge it within 7 business days and provide an estimated timeframe for resolution.
What a complaint may cover. Errors in grammar, syntax or terminology; misinterpretation of the original content; omission of parts of the text; incorrect layout or format compared to the original document; and significant delays beyond the agreed delivery time without prior notice.
How it is handled. Our team reviews the complaint thoroughly, including the original material, the translation and the examples provided. If the complaint is valid, we may offer free revisions to address the issues.
Exclusions. Complaints relating to preferences for style or tone that were not specified before the project began may not qualify for a resolution. Complaints submitted after the 7-day period may not be accepted, except in exceptional circumstances.
24. Payment policy
All services are provided on a 100% prepayment basis. Services do not commence until full payment has been received.
All payments made by clients are received into the bank account of the legal entity operating the website.
Funds allocated for translator remuneration are placed on hold only after the service has been delivered to the client, and remain on hold for fourteen days to allow for potential claims or quality-related requests. This hold period is applied to protect consumer rights. Early withdrawal of these funds is not permitted.
25. Refund policy
Due to the customised nature of translation services, refunds are only considered in cases of non-delivery, or of delivery that deviates substantially from the agreed project requirements. We reserve the right to evaluate each case individually and may offer revisions or alternative resolutions before processing refunds.
As digital translation services cannot be returned once delivered, we provide up to two rounds of revisions free of charge within 7 days of delivery. Revision requests must align with the original project scope and specifications.
If requested changes extend beyond the initial project scope, additional fees may apply. We aim to ensure client satisfaction and will work with you to resolve any issues within the specified revision period.
26. Confidentiality
Client documents are stored securely for one year after project completion and deleted thereafter, unless otherwise requested. All documents and client data are handled confidentially. Access is limited to authorised personnel and to translators bound by confidentiality agreements.
Globolingua undertakes to maintain the confidentiality of the documents transferred to it and of the content of the statements made during the delivery of the Services.
Globolingua undertakes to obtain the same commitment from its translators, interpreters, speakers and any other person contracted or involved in a Service.
27. Dispute resolution
In the event of a dispute related to the use of our website or services, we provide all means to resolve that dispute through negotiations and consultations. Please get in touch with us through customer support to begin the dispute resolution process. The governing law for resolving disputes is the law of England and Wales.

29. Arbitration
If a dispute cannot be resolved through negotiation, we agree that any dispute, controversy or claim arising out of or relating to these Terms of Use shall be subject to arbitration in accordance with the rules and procedures of the London Court of International Arbitration (LCIA), and that the arbitration decision will be binding on both parties.
30. Intellectual property rights
Translations remain the property of Globolingua unless explicitly transferred to the client. Translations may not be reproduced, published or used for legal purposes by Globolingua or by translators without prior consent.
31. Force majeure
Globolingua is not liable for delays or non-performance due to unforeseen events beyond its control, including but not limited to natural disasters, technical failures or political unrest.
